These Terms & Conditions ("Terms") apply to your use of kosherxmp3.com and to any order you make from KosherX ("we", "us"). By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site or place an order.
1. Pre-orders and shipping1. Shipping

We currently ship only to addresses within the United States. You are responsible for entering a complete and correct shipping address. We are not responsible for delays or losses caused by an incorrect address, or by delays with the delivery carrier.
2. Orders, pricing and payment
Prices are in US dollars and are shown at checkout. Devices ordered during the pre-order period are sold at the pre-order price shown on our website, and the regular price applies after that period ends. Shipping is charged separately as a flat rate, which is shown at checkout before you pay. You can also choose to buy extra app slots at the price shown on the Build page. Payment is taken when you place your order and is processed by Stripe. Where required, sales tax is calculated and added at checkout.
We may refuse or cancel an order, for example because of a pricing error, suspected fraud, or because we are unable to fulfill it. If we cancel an order, we will refund any payment you made for it.
3. What is included
Each device comes with a protective case, a charger, a screen protector and wired earbuds at no extra charge.
4. Your device and its apps
You choose apps from our approved catalog on the Build page, up to the limit for each category, and can buy extra app slots to add more. We set up your device with the apps you selected before it ships. Custom apps and sideloading are not supported.
Apps are provided by third parties and are subject to their own terms and privacy policies. We do not control third-party apps, their content or their availability, and an app can change or be removed by its developer. Some apps need an internet connection, or a separate account or subscription with the app's provider.
The device limits which apps can be installed, but we cannot guarantee that the content inside any approved app meets your personal standards. Please review the apps you select before you order.
5. No returns or refunds
All sales are final. We do not offer returns or refunds, except where the law requires it, or as described in section 2 for orders we cancel. Because each device is set up to your selection, please review your order carefully before you pay.
6. Using the device safely
The M1 is not waterproof. Keep it away from water and other liquids. Use the included charger or a compatible one, and follow normal battery safety practices. We are not responsible for damage caused by misuse, accidents or exposure to water.
7. Warranty disclaimer and limit of liability
Except as expressly stated in these Terms, and to the fullest extent the law allows, the site and our devices are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose.
To the fullest extent the law allows, KosherX will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, arising from your use of the site or a device. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
Some places do not allow these limits, so they may not apply to you. Nothing in these Terms limits any right you have under the law that cannot be waived.
8. Using this website
Please use the site lawfully. Do not interfere with it, try to break or bypass its security, use automated tools to overload it or copy it, or submit false information.
9. Intellectual property
The KosherX name, logo, and the content and design of this website belong to us or our licensors, and you may not copy or reuse them without permission. Names, logos and screenshots of third-party apps belong to their owners and are shown only to identify those apps.
10. Bulk orders
We are open to bulk orders. Email sales@kosherxmp3.com for details. Bulk orders may be subject to separate terms.
11. Privacy
How we handle your information is explained in our Privacy Policy.
12. Governing law
These Terms, and any dispute relating to them or to your order, are governed by the laws of the State of New York, without regard to its conflict of law rules.
13. Changes to these Terms
We may update these Terms from time to time. The updated version applies to your use of the site once it is posted. An order you have already placed is governed by the Terms in effect when you placed it.
